Collecting personal information

Personal information has the meaning given by the Privacy Act 1988:

RJL collects personal information from clients and potential clients. This may extend to other professional advisors, or individuals (for example witnesses, or an opposing party) involved in matters.

We collect personal information only if it is reasonably necessary to provide our services, including legal advice and representation, requested by a client.

There are the most common example of personal information that we collect:

  • name;

  • address, telephone number and email address;

  • date of birth;

  • details about the services requested by a client; and

  • details about the services or information RJL provides to a client, including any additional information necessary to deliver our services.

RJL may at times require the provision of sensitive information to enable the provision of our legal services.  Sensitive information has the meaning given by the Privacy Act 1988.

Visiting our website

RJL may collect personal information when you visit this website, or if you decide to contact RJL.

When you visit RJL’s website, our Internet Service Provider will record and collect the following information:

  • the date and time of your visit;

  • the pages you accessed;

  • the website that referred you to us;

  • the internet address you are using; and

  • the type of web browser you are using.

This information is used for statistical and website development purposes only.

Cookies

RJL’s website contains cookies. This is a small saved to a visitor’s computer’s hard drive. The data saved in the cookie may be sent back to RJL’s website.

Cookies do not provide RJL with access to a visitor’s computer, nor any other information. You can choose to accept or decline cookies. A visitor may be able to modify their browser setting to decline cookies.

How RJL collects personal information

RJL collects personal information directly from a client or potential when providing or discussing services, or by using cookies on our website (as set out above).

RJL may collect personal information from third parties or publicly available sources on the internet, or from for example a company search obtained from ASIC.

RJL collects and retains a broad range of personal information gathered during the course of providing our products or services, for example in respect of:

  • a client or potential client of RJL;

  • a director, shareholder, beneficial owner of, or are otherwise associated with, a client or potential client of RJL;

  • engagement with RLJ in receiving our services or enquiring about our services;

  • visiting our website or engaging on social media (for example LinkedIn);

  • subscribe to receive newsletters or information from us;

Purposes of collection

RJL collects and holds personal information (including sensitive information) to:

  • provide the service requested by a client;

  • respond to queries;

  • where reasonable, use or disclose personal information for purposes related to the services or responding to queries about our services;

  • provide information to a client or potential client;

  • communicate generally in relation to our services; and

  • help us manage our services.

RJL may disclose personal information to the following third parties:

  • external providers of services RJL uses to operate our business;

  • comply with our regulatory and legal obligations;

  • manage business systems; and

  • our auditors and accountants.

RJL may also disclose personal information of a client or potential client to:

  • representatives or any other person acting on a client’s behalf (for example, barrister, expert witness, accountants);

  • a court or tribunal in a litigious matter;

  • government or regulatory bodies as required or authorised by law; or

  • referrers who refer clients to RJL.

RJL may disclose your personal information to recipients who are our agents or contractors. The privacy and collection practices of entities to which RJL disclose personal information are governed by their own privacy policies and collection notices.

RJL will not otherwise disclose information unless the disclosure:

  • is required by law;

  • is authorised by law; or

  • consented has been given to RJL disclosing information.

Accessing and correcting your personal information

A client may request access, or correction, to all personal information that we hold, unless there is a lawful reason to decline a request for access or correction.

RJL is not required to provide access where:

  • the information relates to existing or anticipated legal proceedings between RJL and an individual, and the information would not be accessible by the process of discovery in those proceedings;

  • where denying access is required or authorised by law; or

  • providing access would be unlawful.

Changes to this Privacy Policy

RJL may make changes at any time for any reason.

RJL will then investigate the issue and advise you in writing of the outcome.
